Buckle Up Phone Down: It’s the Law

Buckle Up

All drivers and passengers over the age of four must wear seat belts when riding in a motor vehicle in Wisconsin.

Children under four need to be in an appropriate child safety restraint. Visit the WisDOT website for resources on child safety seats.

Wisconsin has a primary enforcement seat belt law, which allows police to stop and ticket a driver for not wearing a seat belt.

Phone Down

Texting while driving is against the law in Wisconsin. The texting ban is also a primary enforcement law.

Drivers with a probationary license or instruction permit are not allowed to use cell phones at all, except to report an emergency.

It is also illegal for anyone to talk on a handheld mobile device while driving in a Wisconsin work zone.

Avoiding dangers

In 2023, distracted driving was a factor in more than 9,200 crashes in the state, including 23 deaths. Those numbers are down 41% from the year before.

Distracted driving is not just a problem among younger drivers. Almost two-thirds of distracted drivers in 2023 were older than 25.

A 2023 observational survey found 8% of drivers in Wisconsin do not buckle up. Unbuckled drivers and passengers made up 46% of all fatalities last year.
